Transnationales »ne bis in idem« zwischen staatlicher Schutz- und Achtungspflicht

Main target of the book is to establish the »ne bis in idem«-principle on a transnational level and clearly define its scope. The »ne bis in idem«-principle is regarded as the outcome of two main (competing) duties of the state: on the one hand the duty to protect certain rights through the application of criminal law in each case and on the other hand the duty to respect the rights of the accused person and especially the general right of personality.
