»The Unborn Contradiction: The Symbolic Protection of Human Life in Vivo, and Its Continued Influence in an Allopoietic Criminal Legislation« German Criminal law shows a number of inequalities with regards to the protection of human life against killing or injury in its pre- and postnatal stages. Taking as its point of departure the rulings of the Constitutional Court on the subject, the study devotes itself to the question whether there are objective reasons for these inequalities. A differentiated analysis of relevant legislation finds that symbolic criminal legislation functionalises legal contradictions, and consequently undermines the autopoietic self-understanding of the legal system. von Berghäuser, Gloria

Über den Autor
Gloria Berghäuser, geboren 1980 in Gießen, ist Referendarin am Oberlandesgericht München und hat an der Universität Passau Rechtswissenschaft studiert. Dort arbeitete sie bereits während ihres Studiums am Lehrstuhl für Strafrecht, Strafprozessrecht und Kriminologie von Prof. Dr. Werner Beulke, der später auch ihre Promotion betreute. Im Anschluss an das Erste Juristische Staatsexamen im Jahre 2008 setzte sie ihr Engagement zunächst am vorbenannten Lehrstuhl als wissenschaftliche Mitarbeiterin und später für die Kanzlei ihres Doktorvaters als freie Mitarbeiterin fort. Ihre mit »summa cum laude« bewertete Dissertation erfuhr die Unterstützung durch ein Promotionsstipendium der Studienstiftung des deutschen Volkes.
